0. Preamble
0.1. Before ordering the services, the customer declares that the reservation of said services is for their personal use.
0.2. As a consumer, the customer has specific rights, which may be questioned if the reserved services are used within their business/professional activities.
0.3. All information available on the Website and Mobile Services, which allow the reservation of services, is provided in Portuguese and preferably in English as well.
0.4. The customer confirms that they have full legal capacity to commit to these terms and conditions.
0.5. The customer accepts the terms and conditions of sale of the Eurosol Hotels and the sales conditions for the reserved rate at the time of booking; reservations cannot be made without this agreement.
0.6. The Customer has the option to save these terms and conditions by using the standard functions on their browser or computer.

E.H. Hotels and Tourism SGPS SA publishes and operates the reservation website for Eurosol Hotels – www.eurosol.pt.
Eurosol Hotels Services
1.1. The Website allows users to book rooms at Eurosol Hotels.
1.2. The customer confirms having received all necessary information from Eurosol Hotels on the Website.
1.3. All bookings made through the Website imply the consultation and full acceptance of these terms and conditions and the sales conditions for the reserved rate.
1.4. The website includes the following information:

The legal notice that allows the precise identification of E.H. Hotels and Tourism SGPS SA and its Hotels and discloses their business names, addresses of their facilities, email addresses, phone numbers, registered offices, tax identification numbers.

1.5. The main features of existing accommodation, prices, and available dates for accommodation are presented on each hotel page during the reservation process.

2. Definitions
The terms used in this document are defined as follows:
“reservation activation”: Email sent by the website to the customer requesting validation of how they intend to make the reservation.
“conditions of sale of the reserved rate”: Specific conditions of each reservation made by the customer regarding payment of the reservation, as well as the possibility of modification or cancellation of the reservation.
“reservation confirmation”: Email sent by the website to the customer summarizing the services reserved by the customer on the website. Acceptance of the reservation confirmation by the customer constitutes a contractual commitment.
“customer”: Any individual who contracts a product or service.
“reservation request”: Reservation request for a hotel room made by the customer through the Eurosol Hotels website.
“partners”: Service providers that allow users to access the website through their own websites, mobile services, or any other tool, including travel operators and price comparison websites in particular.
“online reservation”: Reservation of hotel rooms through the virtual booking form on the website of Eurosol Hotels or reservations through their partners.
“service”: Reservation of hotel rooms whose main characteristics are presented on the Eurosol Hotels website.
“partner service”: Reservation of hotel rooms whose main characteristics are presented in hotel ads available on the website, through any tool of Eurosol Hotels’ partners.
“mobile services”: all services and protocols that enable the connection of mobile devices to the Internet and, in particular, allow for the consultation and reservation of hotel services provided by Eurosol Hotels.
“Site/ Website”: Electronic service operated by Eurosol Hotels on the Internet, available at www.eurosol.pt.

3. Object
3.1. These terms and conditions define the rights and obligations of the parties within the scope of remote reservation of services offered by Eurosol Hotels.
3.2. They cover all necessary stages of reservation and post-reservation between the contracting parties.
3.3. The customer acknowledges having read and accepted these terms and conditions of sale and the sales conditions of the reserved rate, available on the website. By accepting these terms and conditions, the customer expressly accepts the provisions of this document “Terms and Conditions of Sale”.

Scope of application
These terms and conditions of sale apply to all bookings made on the Internet through the Eurosol Hotels website: www.eurosol.pt.

Duration
5.1. These terms and conditions of sale apply as long as the services of Eurosol Hotels are available on the website.
5.2. Eurosol Hotels reserve the right to temporarily or permanently block access to their website, as well as their online booking space, without prior notice.

6. Opposability of Terms and Conditions
In any case, the version of the terms and conditions of sale that binds the customer is the one in force at the time of booking on the website.

7. Reservations
7.1. The client selects the services presented on the website.
7.2. The client confirms that they are aware of the nature, purpose, and methods of booking the services available on the Eurosol Hotels website and that they have requested and obtained the necessary and/or complementary information they needed to make the reservation with full knowledge of the facts.
7.3. On the website, the client can book individually and for their personal needs a maximum of three (3) rooms per reservation. For reservations related to business groups, meetings, seminars, etc., the client should contact Eurosol Hotels directly.
7.4. The client is solely responsible for their selection of services and their suitability to their needs. Eurosol Hotels cannot be held responsible in this regard.
7.5. The reservation is considered accepted by the client at the end of the booking process.

8. Reservation process – Eurosol Hotels Services
8.1. Reservations made by the customer are made through the virtual booking form available online on the Eurosol Hotels website.
8.2. The reservation is considered to be made as soon as Eurosol Hotels confirm it.
8.3. Before making any reservation, the customer must fill in the information requested on the booking form or request.
8.4. The customer confirms the truthfulness and accuracy of the information provided.
8.5. The booking process includes the following steps:

Step 1: searching for a hotel and selecting a room and rate.
Step 2: checking the details of the reservation, total price, and applicable sales terms and conditions, making necessary changes to the selection (room, rate).
Step 3: filling in customer details.
Step 4: reviewing and accepting the sales terms and conditions and rate sales conditions of the reserved rate before confirming the reservation.
Step 5: confirmation of the reservation by the customer.

9. Notice of reservation receipt
9.1. The Eurosol Hotels website confirms the receipt of the customer’s reservation, sending them an email immediately to the address previously entered by them. First, the customer receives the reservation activation request, and subsequently the reservation confirmation. If the customer does not receive the reservation activation request, it is requested to check their spam folder.
9.2. In online reservations, the reservation receipt notice sent by email summarizes the contract offer, the reserved services, prices, sales conditions accepted by the customer regarding the selected rate, the booking date, and the address of the hotel provider’s facilities to which the customer must send any complaints.

11. Cancellation or modification by the customer
11.1. The sales conditions of the reserved rate specify the terms of cancellation and/or modification of the reservation.
11.2. “Non-Refundable” reservations cannot be modified and/or canceled in any way, and the amounts paid in advance as a deposit cannot be refunded. This situation is indicated in the sales conditions of the rate.
Reservations with “pre-payment” are subject to restrictions for their modification or cancellation, and the amounts paid in advance as a deposit can only be refunded according to the conditions indicated in the sales conditions of the rate.
11.3. Whenever allowed by the sales conditions of the reserved rate:

Reservations can be canceled. In the reservation confirmation email, click on “To cancel the reservation click here”
Modifications to reservations can be made directly with the hotel, whose phone numbers are indicated in the reservation confirmation sent by email.
11.4. In case of early termination of the stay by the customer, the total agreed price is generally charged. In case of a reservation with pre-payment, no refund will be made for this reason.
11.5. Unless otherwise stated, the customer must vacate the room by 12:00 on the last day of the reservation. In case of non-compliance, an additional night will be charged.
11.6. Reservations are personal and cannot, under any circumstances, be transferred to third parties, either for free, with some kind of charge, or for commercial purposes.

12. Stay at the hotel
12.1. In accordance with current regulations, the client will be asked to fill out a guest form upon arrival at the hotel. The client’s identification will be requested, through the display of an official document.
If the client refuses to provide the mandatory information to refer to the competent authorities, the Hotel will not be able to provide the requested service.
12.2. Pets are not accepted at Eurosol Hotels, except for guide dogs.
12.3. The client agrees and undertakes to use their room responsibly. Therefore, any behavior contrary to the standards of behavior and public order normally accepted will lead the hotel staff to request that the client leave the premises without any compensation or refund, if any payment has been made. If no payment has been made, the client will have to pay for the nights already enjoyed before leaving the hotel.
12.4. Eurosol Hotels have free WI-FI access that allows the client to have internet access. The client guarantees that the computer resources made available to them by the hotel are not used for the reproduction, representation, provision, or public disclosure of works or objects protected by copyright or related rights, such as texts, images, photographs, music works, audiovisual works, software, or video games, without the authorization of the copyright holder, whenever such authorization is required. The client who does not comply with the aforementioned obligation risks being found guilty of copyright infringement. The client must also comply with the hotel’s internet service provider security policy and the rules for using security resources, the purpose of which is to prevent the unlawful use of computer resources and refrain from acts that may diminish the effectiveness of these resources.

13. Guarantees
13.1. The client will receive a contractual guarantee (for example: reservation confirmation) applicable to the service.

14. Responsibility – General information
14.1. The photographs presented on the Eurosol Hotels website are merely illustrative. Although all efforts are made to ensure that the photographs, graphic representations, and text used to illustrate the hotels represent the accommodation available as accurately as possible, variations may occur, mainly as a result of changes in furniture or possible renovations.
14.2. Eurosol Hotels cannot be held responsible for non-compliance or inadequate compliance with reservations in cases of force majeure, unforeseeable or insurmountable actions by third parties, or actions by the customer, particularly the unavailability of the Internet network, the inability to access the website, external interferences, computer viruses, or unauthorized pre-payment by the cardholder’s bank.
14.3. Hyperlinks may direct the customer to websites other than the Eurosol Hotels website, for which Eurosol Hotels do not assume any responsibility for the content of these websites or the content made available on them.
14.4. Any irregular, ineffective, incomplete, or fraudulent reservation or payment for reasons attributable to the customer will result in the cancellation of the request at the customer’s expense, without prejudice to any civil or criminal action taken against the customer.

15. Complaints
15.1. To facilitate the process, complaints regarding the non-execution or low quality of the hotel’s services must be communicated to Hotéis Eurosol in writing within eight days after the check-out date, either directly to the hotel or through the address of the Customer Support Service indicated above.
15.2. Hotéis Eurosol are operated by legally separate companies from E.H. Hotéis e Turismo SGPS SA and are therefore solely responsible to the client for potential damages. Consequently, in case of a dispute, the client deals exclusively with the company that operates the hotel where they stayed.

16. Prices
16.1. Prices for booking services are indicated before and during the booking process.
16.2. The prices shown are for the room, for the number of people and selected dates.
16.3. Prices are confirmed to the customer with all taxes included in the hotel’s commercial currency (euros) and are only valid for the period indicated on the website.
16.4. All bookings, regardless of their origin, must be paid in euros.
16.5. Unless otherwise stated on the website, additional services (half board, full board, etc.) are not included in the price.
16.6. Prices include the applicable VAT on the day of booking, and any changes to the VAT rate will be automatically reflected in the prices shown on the billing date.
16.7. Any changes or introduction of new legal or regulatory fees imposed by competent authorities will be automatically reflected in the prices shown on the billing date.
16.8. Foreign currency conversion is indicative and not contractual. Only the currency confirmed in the reservation is guaranteed (if this currency is different from the one used in the hotel, any possible exchange rates are the responsibility of the customer).
16.9. When confirming the customer’s reservation, Eurosol Hotels will indicate the total amount of the order.
16.10. Rates may increase due to various taxes, depending on the city. The customer agrees to pay these taxes, without holding Eurosol Hotels responsible.
16.11. Some promotional offers available online are sold exclusively on the Internet, meaning remotely, and never at the hotel reception.

Payment
17.1. The customer may be asked to provide their bank details as a guarantee for some reservations, except in cases where special conditions apply, using a credit or debit card (Visa, MasterCard, American Express, Diners Club, etc.), the redunice@payments tool may also be used, or a bank transfer may be made, according to the selected hotel, in the case of credit card use, it must be presented by the holder at check-in. The hotel may also request an identification document to prevent possible credit card fraud.
17.2. Credit card payment is charged at the hotel during the stay, unless special conditions or rates apply due to payment at the time of booking (online prepayment on certain rates). This prepayment serves as a deposit. In the case of a rate that does not require online prepayment, the hotel may request a deposit or a credit card debit authorization upon arrival at the hotel, in order to guarantee payment of the amounts corresponding to the services provided by the hotel during the stay.
17.3. Members of the Eurosol Hotels loyalty program can use their points to book part or all of a stay on the Eurosol Hotels website, provided that:
they redeem a minimum number of points defined in the Preferred Card regulations;
the reserved rate is eligible, subject to availability, at the hotel selected by the customer. If the expression “rate not cumulative with the benefits of the preferred card” is displayed on the page with the available rates, the rate is not eligible.

17.4. In case of no-show (reservation not canceled – customer does not show up), the hotel will debit a fixed fee as compensation, equivalent to the amount of the first night of the reservation. Any additional nights booked will be canceled at no charge, unless otherwise stated in the sales conditions of the reserved rate.
17.5. Eurosol Hotels have chosen redunice@payments (payment service provider). Payment cards may be rejected for various reasons: stolen or blocked card, credit limit reached, input error, etc. In case of problems, the customer will have to contact their bank and the hotel to confirm the reservation and method of payment.

18. Conservation – Archiving
18.1. Eurosol Hotels guarantee the archiving of the written document confirming the conclusion of any contract from the moment of conclusion until the provision of services, for a period of twelve (12) years. Access to this document is also guaranteed at any time during this period.
18.2. Contractual documents are archived in electronic or paper format.

19. Privacy and protection of personal data
19.1. Eurosol Hotels process personal data for which they are responsible.
19.2. If essential information is not provided, Eurosol Hotels may not be able to register the reservation, manage the customer’s participation in the loyalty program, or handle customer complaints.
19.3. The processed information is intended for E.H. Hotels and Tourism SGPS SA, service providers (in particular payment service providers), and Eurosol Hotels.
19.4. The data collected by Eurosol Hotels includes identification data, contact information, personal and professional data, economic and financial information. The data may be disclosed to partners located in any country in order to provide the services that the customer wishes to enjoy, when such flows are necessary as part of the contractual relationships between Eurosol Hotels and the customer, or the contractual relationships between Eurosol Hotels and a third party in the customer’s interest.
19.5. In the context of pre-contractual measures with the aim of booking or executing the hotel reservation contract, each of them may, as relevant, be the recipient of identification data, personal and professional data, as well as economic and financial information, particularly for the execution of the reservation at the hotel, for the management of the loyalty program, and for handling complaints.
19.6. The customer can authorize Eurosol Hotels to disclose their personal data to third parties in accordance with the Privacy Policy (available on the website www.eurosol.pt).
19.7. The customer has the right to withdraw consent for the processing of personal data by sending a written statement to rgpd@eurosol.pt.
19.8. As the data subject, you have the right to access, rectify, erase, restrict processing, as well as the right to data portability and to object to processing, by sending a written statement to rgpd@eurosol.pt.
19.9. Eurosol Hotels may specifically send a satisfaction survey to the customer after their stay.
19.10. Eurosol Hotels may request the customer’s consent to send newsletters, promotions, products and services of Eurosol Hotels, and NOV Group companies.
19.11. Some Eurosol hotels process personal data for prevention and to ensure the security of property and people, as well as to address outstanding debts. For these reasons, the hotel may decide to include any customer whose behavior has been inappropriate in the category of “blacklist” through forms of aggression and rudeness, breach of the hotel contract, non-compliance with safety rules, theft, damage, vandalism, or payment-related issues. This data is mandatory. Being on the blacklist may result in the hotel where the listing originated refusing to book a returning customer. Data related to blacklisting and the customer’s identity are intended for authorized personnel at the hotel where the listing originated, as well as the other Eurosol Hotels.

20. Proof agreement
20.1. The introduction of the necessary data, as well as the acceptance of these terms and conditions, the sales conditions for the reserved rate and the form or reservation request, as well as any specific conditions of the Eurosol Hotels by email constitute an electronic signature with the same value as a physical signature on paper between both parties.
20.2. The computer records held in the IT systems of the Eurosol Hotels – NOV Group are kept under reasonable security levels and are considered as evidence of communication, orders and payments between the parties.
20.3. The customer is hereby informed of the information we record at the time of booking: IP address; geographical location; Information about the device accessing the website, including browser type and version, operating system, screen resolution, preferred language, information in HTTP headers, and agent version; the search engine used to locate and access the website, date and time of activity on the website, as well as web pages and content visited and clicked. It is important to note that this usage information does not deliberately identify you, and if it does exceptionally identify you, it will be anonymized immediately. By providing information, you are giving your informed and unequivocal consent to the automated processing of data concerning you. Some of the requested data are mandatory, and they are identified, and the lack or inaccuracy of the answers given may compromise the service provided.

21. Relocation
In the event that the selected hotel is not available, or in cases of force majeure, the hotel reserves the right to accommodate the client fully or partially in a hotel of equivalent or superior category for the same type of services. Any additional costs related to the room, transportation between the two hotels, or phone calls are the responsibility of the selected hotel.

22. Force Majeure
22.1. The concept of force majeure is understood as any event beyond the control of the Parties, of unpredictable and insurmountable nature, that prevents the Client or the Hotel from fulfilling all or part of the obligations set forth in the contract. Cases of force majeure or fortuitous events are commonly recognized by the jurisprudence of Portuguese courts.
22.2. Neither party shall be held liable to the other in the event of non-compliance with its obligations as a result of a force majeure event. It is expressly agreed that force majeure suspends, for both parties, the execution of their reciprocal obligations and that each party must bear the resulting costs.

23. Dispute Resolution
23.1. In case of a dispute related to these terms and conditions, the customer is informed by E.H. Hotels and Tourism SGPS SA about the possibility of resorting to a conventional mediation procedure or any alternative methods of dispute resolution.
23.2. The guest must first contact the hotel to try to resolve the dispute amicably. If the response is negative or in the absence of a response within thirty (30) days, they can contact qualidade@eurosol.pt.

24. Applicable Law
The terms and conditions of sale of Eurosol Hotels are regulated by Portuguese legislation.

25. Totality of the agreement
25.1. General information
25.1.1. These terms and conditions of sale, the terms and conditions of sale of the rate reserved by the customer, and the form or reservation request of Eurosol Hotels express the obligations of the parties in their entirety.
25.1.2. No specific or general condition communicated by the customer can be incorporated into these terms and conditions.
25.1.3. The documents that constitute the contractual obligations between the parties are, in descending order of priority, the form or reservation request (which covers the specific conditions of the reserved rate) and these terms and conditions.
25.1.4. In case of dispute between the reservation form and the terms and conditions, only the provisions of the reservation form are applicable to the obligation in question.
25.2. Partner services
25.2.1. In case of conflict between the general terms and conditions or the terms and conditions of use of the website, or between the terms and conditions of sale of a partner, and the present terms and conditions of sale of Eurosol Hotels, only the provisions herein apply to the obligation in question.

26. Nullity
26.1. If one or more provisions of the terms and conditions of sale of Eurosol Hotels are deemed invalid or so determined either by the application of a law or regulation or following a final judgment of a court with competent jurisdiction, the other provisions remain valid and in force.

27. Language
27.1. The official language is Portuguese.
27.2. If the terms and conditions of the Eurosol Hotels are translated into a foreign language, the Portuguese language will prevail over any other translation in case of a dispute, legal action, difficulties in interpretation or in the execution of these terms and conditions of sale, and, more generally, concerning the relations existing between the parties.

28. Development/modification of terms and conditions of online sales
These terms and conditions of online sales may be modified and/or added to at any time by Eurosol Hotels. In this case, the new version of the terms and conditions of online sales is made available online by E.H. Hotels and Tourism SGPS SA and automatically applies to all customers with immediate effect, except for bookings made before the date of online publication of the conditions. For these bookings, the version of the terms and conditions previously accepted remains applicable.
The customer must also consult the supplementary sales terms and conditions related to each rate, room type, or service type presented in the specific booking conditions.
